Terms of Service
Last updated: 30 July 2026
These Terms of Service ("Terms") are an electronic agreement between you and MIGZO (sole proprietorship of Sarita Rani Miglani), a sole proprietorship of Sarita Rani Miglani, trading as "MIGZO" (GSTIN 03DXEPM3001B1ZE, Punjab, India) ("Migzo", "we", "us", "our"). They govern your use of the Migzo mobile application (Android package com.bookmigzo.app), the website bookmigzo.com, and the services offered through them (together, the "Service"). By creating an account or placing an order you accept these Terms. If you do not agree to them, please do not use the Service.
1. What Migzo is
Migzo is an order-ahead, self-pickup marketplace for restaurants in India. You browse menus of participating restaurants, pay for your order online in advance, and collect it yourself from the restaurant's counter when it is ready. Migzo does not provide delivery.
Migzo is an intermediary marketplace. The restaurant you order from is the seller of the food and the food business operator under the Food Safety and Standards Act, 2006 (FSSAI). Migzo provides the technology that connects you to the restaurant and facilitates the order and payment; it does not prepare, handle, or sell food itself.
The Service is available in select cities in India; the in-app city selector shows where Migzo currently operates.
2. Eligibility
- You must be at least 18 years of age to use the Service.
- You must have a valid Indian mobile number capable of receiving one-time passwords (OTPs) by SMS or WhatsApp.
- By using the Service you represent that you meet these requirements.
3. Your account
- You sign in with your phone number and a one-time password. Each phone number is associated with one Migzo account.
- You are responsible for all activity under your account. Do not share an OTP with anyone; Migzo staff will never ask you for it.
- Tell us promptly at support@bookmigzo.com if you suspect unauthorised use of your account.
- Your use of personal data through the Service is governed by our Privacy Policy, to which you give versioned consent at sign-in under the Digital Personal Data Protection Act, 2023.
4. Orders, prices, and payment
4.1 Placing an order
An order you place is an offer to purchase the selected items from the restaurant at the listed prices. Payment is collected in full, online, at the time of ordering. The restaurant then confirms and prepares the order; you are told through the app when it is ready for pickup.
4.2 Prices and fees
- Menu prices are set by the restaurants. GST on food is applied as required by law and shown before you pay.
- Migzo does not add any platform or convenience fee to your order. If a platform fee is ever introduced, it will appear as its own line, inclusive of GST, at checkout before you pay — never afterwards.
- The total shown at checkout is the full amount you are charged; there are no hidden charges.
4.3 Payment processing
Payments are processed by Razorpay, a PCI-DSS-compliant payment gateway. Migzo never stores your card number, CVV, UPI PIN, or banking credentials; we receive only a payment confirmation and transaction reference. Your use of the gateway is also subject to Razorpay's terms.
4.4 Invoices
A GST-compliant invoice is issued for every completed order and is available from the order's detail screen in the app.
5. Pickup and no-shows
- When your order is ready, collect it from the restaurant's counter and quote the pickup code shown in the app. The code is how the restaurant verifies the handover, so do not share it before collection.
- Please collect your order promptly once it is marked ready. Prepared food cannot be held indefinitely.
- If you do not collect an order after it has been prepared and made ready, the order is marked not collected and the payment is retained by the restaurant, because the food was prepared for you in good faith. Details are in the Refund & Cancellation Policy.
6. Cancellations and refunds
The Refund & Cancellation Policy is part of these Terms. In summary:
- Because payment is taken upfront and the restaurant starts work on confirmation, a paid order cannot be cancelled by you.
- You receive an automatic full refund if the restaurant rejects your order, does not confirm it within its confirmation window, or cancels it after accepting.
- Refunds go back to the original payment method through the payment gateway, typically within 5–7 business days.
- Problems with a collected order (wrong, incomplete, or unfit items) must be reported through the app within 24 hours of pickup.
7. Restaurant content and food safety
Restaurants are solely responsible for their menus, prices, item descriptions, images, veg/non-veg classification, allergen declarations, and the quality and safety of the food they prepare. Migzo requires partner restaurants to hold a valid FSSAI licence, but as a marketplace it does not and cannot verify every listing. If you have allergies or specific dietary requirements, confirm directly with the restaurant before ordering.
8. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of applicable law;
- place fraudulent orders, use payment instruments you are not authorised to use, or abuse the refund process;
- harass, abuse, or threaten restaurant staff, other users, or Migzo support;
- interfere with, reverse-engineer, or attempt to gain unauthorised access to the Service or its infrastructure;
- use bots, scrapers, or automated tools on the Service without our written permission; or
- create multiple accounts to evade restrictions or offer limits.
We may suspend or terminate accounts that breach this section, and may withhold or reverse benefits obtained through the breach.
9. Offers and promotions
Where Migzo or a restaurant runs an offer or promotional pricing, the offer's own stated conditions apply in addition to these Terms. Offers may be changed or withdrawn at any time, and misuse (including multiple accounts) may lead to reversal of the benefit.
10. Intellectual property
The Migzo name, wordmark, app, website, and software are the property of MIGZO (sole proprietorship of Sarita Rani Miglani). Restaurant menus, names, and images belong to the respective restaurants. You may not copy, modify, distribute, or create derivative works from the Service without written consent, except as permitted by law.
11. Limitation of liability
- Migzo, as an intermediary marketplace, is not liable for the quality, safety, or suitability of food prepared by restaurants; your remedy for food-related issues lies against the restaurant, and Migzo will assist in facilitating a resolution as described in the Refund & Cancellation Policy.
- Migzo is not liable for delays or failures caused by events beyond its reasonable control.
- To the maximum extent permitted by law, Migzo's aggregate liability for any claim arising out of an order is limited to the amount you paid for that order.
- Migzo is not liable for indirect, incidental, special, or consequential loss, including loss of profits, data, or goodwill.
Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019 that cannot be limited by agreement.
12. Indemnity
You agree to indemnify MIGZO (sole proprietorship of Sarita Rani Miglani) and its personnel against claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of law or of a third party's rights.
13. Account deletion
- You may delete your account at any time from Profile → Delete account in the app, or by writing to support@bookmigzo.com.
- Deletion takes effect after a 30-day grace period, during which you can change your mind by simply signing back in.
- After the grace period your personal identifiers are permanently deleted or anonymised. Records that Indian tax law requires us to keep (GST invoices and transaction records) are retained for a minimum of 6 years in a form no longer linked to you personally.
- The full process is described on the account deletion page.
14. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. When we make material changes we will update the "Last updated" date above and ask you to accept the revised Terms at your next sign-in. If you do not agree with the revised Terms, stop using the Service and delete your account.
15. Grievances
If something has gone wrong, raise it in the app or write to support@bookmigzo.com. Complaints that are not resolved to your satisfaction can be escalated to our named Grievance Officer, whose contact details and timelines (acknowledgement within 48 hours, resolution within one month) are published on the Grievance Redressal page, in accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
16. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any law conferring jurisdiction elsewhere, the competent courts in Punjab, India shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
